Terms and conditions
Here you will find the general terms and conditions that apply to a lesson/trial lesson/massage/workshop/rental and other activities organized by Heart to Heart. If you have any questions after reading, please contact us. Heart to Heart is located in the Heart House building, Huizerweg 54 Bussum, and is registered with the Chamber of Commerce no.: 32057019.
Applicability of general terms and Conditions Heart to Heart:
- These general terms and conditions Heart to Heart apply to every legal relationship between a consumer (participant/tenant) who participates in an activity, lesson, workshop, treatment, offered and/or provided by Heart to Heart or rents a room for an own event at Heart to Heart.
- By the agreement that participant/tenant concludes with Heart to Heart, participant/tenant agrees to these general terms and conditions.
- Only if this has been deviated from in writing, these general terms and conditions will be completely or partially excluded.
- Heart to Heart may change these Terms and conditions from time to time. The latest version is always the current version and is always available on the website of www.hearttoheart.nl
- If a provision or part of a provision in these general terms and conditions is contrary to a decision, law, regulation, treaty or European directive, is deemed unreasonably burdensome or is void or annulled on the basis of any decision, law, regulation, treaty or European directive, only the void or annulled provision whether the void or voided part of the relevant provision shall remain inapplicable, and Heart to Heart is permitted to apply a replacement provision that is legally permissible and matches as much as possible the scope and content of the (partially) void or voided provision.
Agreement
1. An agreement between Heart to Heart and Participant/tenant arises by agreement between both parties, which agreement must be evidenced by registration of Participant/tenant or other fixed agreements that have been confirmed by e-mail.
2. For Heart to Heart, obligations arise from an agreement, after all his obligations, including payment, have been fulfilled by the participant/tenant.
3. Changes to an agreement once concluded can only be made with the prior written consent of Heart to Heart. Modification of an agreement may incur costs for the participant/tenant.
4. An agreement between Heart to Heart and Participant/tenant consists of:
* Rental of a space for your own event by tenant
* A massage that is paid for a certain number of minutes by the participant
* A workshop given by Heart to Heart specifically chosen by Participant
Payment
1. Unless otherwise agreed, payments must be made by Bank, automatic transfer, by pin if available.
2. Subject to applicable law, participant/tenant shall owe Heart to Heart all costs incurred by a third party engaged by Heart to Heart to collect any amount that participant/tenant owes to Heart to Heart.
3. Heart to Heart has the right to suspend the performance of its obligations if the participant/tenant has not fulfilled its obligations in a timely manner.
4. When renting a room / purchasing an arrangement, 7.5% Handling and service costs will be charged on the total amount of the invoice.
Termination of rental agreement of a space at Heart To Heart Center
1. As soon as the rental agreement between the tenant and Heart to Heart Centrum has been confirmed by e-mail, it means that this is a final agreement that will be included in the Heart to Heart agenda. As soon as it is listed in the online calendar, the landlord, Heart to Heart, assumes that the space will be used by the tenant for the specified date and time.
2. Cancellation of the session rooms can take place up to 24 hours before the appointment is made unless otherwise agreed.
3. Options on rooms of a multi-day event expire 1 month before the event and are converted into a final reservation, unless otherwise agreed or discussed and recorded by email. Options on rooms of 1 day or less expire 3 weeks in advance and are automatically converted into a final booking. This applies at all times unless otherwise agreed in writing.
4. The renter can cancel the Prana Hall, Anahata Hall and Jyotizaal free of charge up to 4 weeks in advance when it comes to multi-day events and 3 weeks in advance when it comes to an event of 1 day (or less than 1 day). For a multi-day event, 25% of the rental price will be charged in case of cancellation between 4 and 3 weeks. Between 3 and 2 weeks before the event 50% of the rental price. And between 2 weeks before the event and the actual moment of the planned event 100% of the rental price. For one-day events or shorter meetings, 50% will be charged between 3 and 2 weeks before the event. If canceled less than 2 weeks in advance, 100% will be charged.
5. We ask you to keep in good contact about any possible cancellation in order to save costs for the tenant and to keep space open for the landlord for possible other potential tenants. Heart to Heart can also cancel the rental itself up to 4 weeks before the booked event at no cost. Also, under the influence of changes in the COVID-19 measures in the 4 weeks prior to the time the rental period begins, Heart to Heart reserves the right to cancel the rental. Other agreements can be made in consultation.
6. Cancellations of the catering (requested lunches / coffee/tea packages etc) can be communicated no later than 3 working days in advance and canceled free of charge. We will process the order within 72 hours.
7. Administration costs may be charged for changes to an arrangement.
Participation in and cancellation of a lesson, meeting organized by Heart to Heart
1. A participant must register with the teacher before a lesson, by e-mail or telephone to Heart to Heart. Without permission, a participant is not entitled to participate in a lesson or workshop or participation.
2. Heart to Heart is entitled to adjust the training schedule and/or the training locations in the meantime without giving any reason. The latest schedules and locations are always the current ones and they are always available on the Heart To Heart website.
3. Heart to Heart has the right until the time of commencement to cancel a regular lesson or planned workshop or meeting or treatment in case of insufficient interest. The minimum number of participants is 3 participants. In that case, charged strips will be credited.
4. Extraordinary circumstances always result in force majeure for Heart to Heart and relieve Heart to Heart of its obligations. In the event of permanent force majeure, Heart to Heart is released from its obligation to comply with the agreement.
5. In the event of dangerous weather conditions, including thunderstorms, storms, extreme heat, snow or sleet, a lesson may be cancelled. Heart to Heart is not liable for the failure of workshop or lesson or treatment due to dangerous weather conditions.
6. If a participant creates such a nuisance or nuisance that a proper execution of a lesson or meeting is thereby complicated, it can be excluded by Heart To Heart de les, meeting. All resulting costs will be borne by the participant.
7. A student of one of the events organized by Heart to Heart can cancel his/her participation free of charge 10 days in advance.
8. Written registration for a retreat is a final confirmation. Up to 60 days before the retreat (event of more than 3 days at home or abroad) can be canceled free of charge. Within 60 days, the entire amount will be charged.
House Rules yoga classes
1. You are welcome at the Heart Café before your class/treatment / appointment begins. When a room is still occupied, before your class starts, you can wait quietly in the hallway in the center near the seating area.
2. Please do not enter the rooms with shoes during the yoga classes. You can take off your shoes in the dressing room. You can hang coats in one of the wardrobe areas, or in the dressing room upstairs near the center.
3. Please do not bring tea in the yoga room. Bottles of water are allowed.
4. As a yoga student you can enjoy a free cup of tea before or after class. Would you please put your teacup on the dish rack when leaving the center?
5. During classes there is a calm and quiet atmosphere, in the hall and also in the hallway. We ask respect for that. Like to rest in the corridor around the massage rooms and the yoga rooms.
6. Please keep quiet on the parking lot in the evening. Conversations are heard in the halls.
7. Missed lessons can be made up within a month.
8. If the teacher is unable to attend, the classes will be taken over by other yoga teachers who are affiliated with the center.
9. Heart to Heart reserves the right to make changes to the class schedule; so look for the most current schedule on the website.
10. For overall hygiene, use a (hand)cloth on your yoga mat.
11. You can bring your own mat and blanket.
12. Trial lessons are € 15,-. You will then receive the second trial lesson for free, provided it is used within 1 week. You can take this with you in cash.
Liability
1. Participation in a class or meeting or massage treatment, or rental of a room, is at your own risk.
2. Heart to Heart's employees, teachers, therapists, are not liable for personal injury or damage to property of a participant in a Training. Your children are also seen as participants.
3. Heart to Heart is also not liable for possible damage caused by other services or advice from Heart to Heart , its employees and teachers and massage therapists.
4. Heart to Heart is not liable for any injury or other damage that the participant may suffer during, or as a result of, a workout. Advice is always without obligation and is followed at your own risk.
5. Heart to Heart is not liable for damage to and/or loss of personal property due to any cause, arising during or in connection with a lesson or meeting or treatment. A yoga class can be intense and injury-prone. The participant must assess whether he / she is suitable for participation and is responsible for adjusting the intensity of the exercises. If a participant has health complaints, or if a participant has any other reason to doubt a participation, the participant should seek advice from a doctor.
6. Heart to Heart reserves the right to exclude, in its opinion, unsuitable participants from participating in a lesson or treatment
7. Heart to Heart is not insured for damage of Participant / tenant. Participant/tenant, contractual partner or other party declares that it is insured for damage suffered as a result of participation in a lesson or meeting.
8. The participant / tenant hereby unconditionally and irrevocably waives its right to compensation for any direct or indirect damage (whether from an agreement or unlawful action) that has arisen, arises or will arise in connection with participation in a lesson or rental of a space.
Website, disclaimer and privacy
1. Heart to Heart respects the privacy of its participant/tenant and ensures that the personal and/or confidential information that is provided and/or obtained (the data) is treated confidentially.
2. Heart to Heart only uses the data to execute the agreement with the participant/tenant as quickly and efficiently as possible. For the rest, Heart to Heart will only use this information with the prior consent of the participant/tenant.
3. Heart to Heart will not sell the data to third parties and will only make it available to third parties who are involved in the execution of the agreement.
4. The executive employees of Heart to Heart and third parties engaged by it are obliged to respect the personality and/or confidentiality of the data.
5. The information provided on the website www.hearttoheart.nl and www.hearthouse.nl for general information purposes only. Due to external circumstances, delays, defects and/or other imperfections may occur in the information provided.
6. Although Heart to Heart takes the greatest possible care in the composition and maintenance of its website, Heart to Heart cannot guarantee that the information provided is complete, current and/or accurate. The participant / tenant hereby unconditionally and irrevocably waives its right to compensation for any direct or indirect damage that has arisen, arises or will arise through the use of the data, unless there is intent or gross negligence on the part of Heart to Heart.
7. The websites of third parties to which hyperlinks are included on the Heart to Heart website are not controlled, created and/or maintained by Heart to Heart. Heart to Heart therefore accepts no liability for the content of these linked websites.
8. The participant declares to be aware of and agrees with the Privacy Statement Heart to Heart.
Complaints
1. Participant / renter must report a complaint regarding any performance of Heart to Heart as soon as possible after the defect or damage has been discovered to Heart to Heart, and no later than fourteen (14) days after the participant has discovered the defects or damage. The complaint is submitted to Heart to Heart by telephone or digitally, stating the location and a description of the complaint.
2. The complaint must be complete, clearly described and provided with any means of proof.
3. Heart to Heart will respond to the complaint submitted by the participant/tenant as soon as possible, but at the latest within four (4) weeks from the date of receipt. If Heart to Heart expects to require a longer period of time for the processing of the complaint, it will inform the participant/tenant immediately by e-mail after this has been noted.
4. If the complaint cannot be resolved by mutual agreement, a dispute arises in accordance with Article 11 (C) of these general terms and conditions Heart to Heart.
Disputes and applicable law
Heart to Heart can only deviate from these general terms and conditions if this has been confirmed in writing by Heart to Heart.
1. This agreement is governed by Dutch law.
2. Disputes arising from this agreement, which cannot be resolved by mutual agreement, will be subject to the competent court.
